Rental terms and conditions
RODA · 125cc scooter rental · Sant Joan d'Alacant (Alicante, Spain)
1. Scope
These terms govern the rental of 125cc motorcycles without driver by Jose Ignacio Muñoz Delgado, tax ID 48628752J, Av. Hospital, 10, 03550 Sant Joan d'Alacant, Alicante ("RODA"). Making a booking through any channel implies acceptance of these terms.
2. Booking and confirmation
A booking is firm once the rental has been paid and RODA confirms it. Identity and licence verification, contract signature and key handover take place in person at pick-up.
3. Prices and payment
- Prices include VAT (21%), mandatory insurance, helmet and 300 km per rental day. A 50 km allowance applies; beyond that, any kilometres over the limit are charged at the end of the rental at €0.10/km. For long stays (28 days or more) the limit is agreed monthly: 2,000 km per month.
- The rental is paid by card at the time of booking (secure gateway).
- The full card number is never stored.
4. Security deposit
A 300€ deposit is required at pick-up (cash or card), returned after the vehicle is handed back undamaged, with the same fuel level and no pending fines. It may be applied to: damage not covered by insurance, missing fuel, exceptional cleaning, lost keys or helmet, or late return.
5. Rider requirements
- Minimum age: 21.
- Valid licence: A1, A2, A, or B held for at least 3 years.
- Original ID/passport and driving licence (both sides) at pick-up. Foreign riders: licence valid in Spain or international permit.
- Only persons registered as riders in the contract may ride.
6. Use of the vehicle
Forbidden: subletting or lending to unauthorised third parties; riding under the influence of alcohol or drugs; racing or competitions; taking the vehicle out of Spain without written authorisation; carrying dangerous or illegal goods; riding without an approved helmet. Serious breach entitles RODA to terminate without refund.
7. Insurance and liability
The vehicle carries mandatory third-party insurance. The customer's liability for damage is limited to the deposit, except in cases of intent, riding under the influence, without a valid licence or manifest breach, where liability is unlimited. RODA does not offer supplementary insurance.
8. Fuel
The scooter must be returned with the same fuel level; otherwise the fuel cost plus handling fees will be deducted.
9. Traffic fines
Fines during the rental are the customer's responsibility. RODA is legally required to identify the rider to the authorities (arts. 9 bis and 11, Royal Legislative Decree 6/2015). Unpaid fines plus handling fees may be charged to the customer.
10. Cancellations
More than 48h before pick-up, full refund; 24–48h, 50%; less than 24h or no-show, no refund. As a service with a fixed date, the 14-day withdrawal right does not apply (art. 103.l, Spanish Consumer Act).
